Mediation Services

Mediation is required in Utah prior to requesting a final trial date in all family law cases. Aside from the legal requirement, there are many benefits to using mediation to resolve family law cases.

  • Mediation resolves most family law cases without waiting months and even years to get to trial.
  • Mediation that results in a settlement agreement saves each party tens of thousands of dollars in attorney fees.
  • Mediation allows the parties to control the language each party wants included in their final decree of divorce.
  • Mediation can address very important details that a judge would not likely address in a ruling, such as parenting plans that address the specific needs of the parents and the children, or specific timing on the division of assets and debts.
  • Mediation reduces the conflict between the parties as a neutral mediator can help bridge the communication gaps between parties and their attorneys.
  • Mediation allows parents to co-parent more effectively after reaching an agreement than if the parties had proceeded to an adversarial trial where each party is cross-examined by the other party’s attorney for hours.

Mediation can occur with or without attorneys. In general, a party will want to have legal counsel present if the other party is going to have their attorney attending mediation. However, it is not uncommon for both parties to attend mediation without an attorney.

Mediation is often required prior to requesting a modification of an existing decree. Often parties will mediate potential modifications without attorneys to save on attorney fees. Having an attorney serve as mediator who can draft and file your legal documents can save you time and money while providing you with peace of mind that the divorce was done correctly.

Qualified Domestic Relations Orders (QDROs)

Often parties that divorce need to divide retirement accounts. The federal government has provided a mechanism to divide retirement accounts in a divorce action without incurring penalties for the withdrawal of retirement funds prior to retirement ages. The Qualified Domestic Relations Order (QDRO) is an order signed by the court that is then sent to a retirement administrator who will divide the retirement account without triggering penalties for early withdrawals or without incurring unnecessary tax liabilities for the division of the retirement funds of one of the parties. This process can be complicated and usually requires the help of an attorney. Choice Legal Services has been preparing QDROs for years and has the financial experience to navigate common pitfalls that come with dividing retirement assets.
